A person may face charges related to the possession of child pornography if they are accused of knowingly acquiring, storing, or accessing CSAM on a device such as a computer or smartphone or possessing physical materials such as photographs, videotapes, or films. The specific charges in these cases may include:
- Maryland CSAM Possession Charges: Under Maryland Code, Criminal Law Section 11-208, possession of CSAM is punishable by up to five years in prison and a $2,500 fine per count. A conviction will generally lead to Tier I sex offender registration for 15 years. - Federal CSAM Possession Charges: Under 18 U.S.C. 2252, possession of CSAM is punishable by up to 10 years in prison. Offenses involving producing, promoting, or distributing child pornography are punishable by prison sentences of up to 10 years. A conviction for this type of offense will require Tier II sex offender registration lasting for 25 years.
When charges related to producing or distributing child pornography are prosecuted at the federal level, the penalties may be even harsher. Charges of distributing child pornography will result in minimum prison sentences lasting for five years. These charges may also address the "receipt" of CSAM, and the same penalties will apply. In cases where someone is accused of producing child pornography, including the transportation of a minor in "interstate or foreign commerce" in order to create CSAM, the mandatory minimum sentence is 15 years, and the maximum sentence is 30 years.
