Unlawful Possession of a Firearm

Under Maryland Code, Criminal Law Section 4-203, people are prohibited from carrying or transporting handguns except in certain circumstances. People who have permits to wear, carry, or transport firearms may do so, and a person may keep firearms on property they own or lease. Exceptions also apply for law enforcement officials, members of the military, bona fide gun collectors, supervisory employees who carry handguns in the course of their employment, people who are transporting firearms after purchasing them or when taking them to or from a repair shop, and using guns for target practice or hunting.

A violation of this law is typically charged as a misdemeanor offense. For a first offense, a person may be sentenced to between 30 days and five years in prison, and/or they may be fined between $250 and $2,500. In cases where a person is charged with unlawfully carrying a firearm on public school property, the minimum sentence is 90 days. For a second offense, a person may be sentenced to between one and 10 years in prison, or if they are charged with carrying a gun in a school, they may be sentenced to three to 10 years in prison. A third or subsequent offense carries a sentence of three to 10 years, or five to 10 years in cases involving carrying a firearm in a school.

Using a Firearm During a Violent Crime

People who are accused of using a firearm when committing a violent crime may face weapons charges in addition to the charges related to the underlying offense. Under Maryland Code, Criminal Law Section 4-204, the use of a firearm in the commission of a crime of violence is a misdemeanor offense that can lead to a prison sentence ranging from five to 20 years. This sentence will be in addition to any penalties imposed for convictions of other crimes.
