Penalties for Accessing Child Sex Abuse Material in Maryland
The possession of child sex abuse material is a serious offense under Maryland law, and it is governed by Maryland Code, Criminal Law Section 11-208. Materials may be considered CSAM if they depict an actual, identifiable child under 16 in a state of sexual excitement, engaged in sexual conduct, or being subject to sadomasochistic abuse. Materials may include photos, videotapes, and films, as well as drawings that depict an identifiable child.
A conviction of possession of CSAM carries a potential sentence of five years in prison per count, as well as substantial fines. A conviction will also typically require a person to register as a Tier I sex offender. In these cases, a person will typically remain on the sex offender registry for 15 years. However, Craig M. Penalties for Distributing or Producing Child Sex Abuse Material in Maryland
Offenses related to the production of child sex abuse material or the distribution of CSAM are even more serious than charges of CSAM possession. Maryland Code, Criminal Law Section 11-207 addresses the acts of producing CSAM by filming or photographing children engaging in sexual conduct, using a computer to "depict or describe" CSAM, promoting or advertising CSAM, distributing CSAM, or using a computer to share a child's identifying information in order to facilitate unlawful sexual activities. This statute also prohibits people from inducing, allowing, or soliciting children to create CSAM. Offenses under these statute are felony offenses that may lead to a sentence of up to 10 years and/or a fine of $25,000. A conviction will also require a person to register as a Tier II sex offender for 25 years.
