Child Abuse Charges
Child abuse in Maryland is governed by Maryland Code, Criminal Law Section 3-601. Child abuse is defined as a physical injury resulting from cruel or inhumane treatment or as a result of a malicious act that threatens the child's health or welfare. First-degree child abuse may be charged if a child suffers a serious injury or is killed as the result of abuse. This is a felony offense that may be punishable by up to 25 years in prison. If abuse resulted in the death of a child between the ages of 13 and 18, the maximum prison sentence increases to 40 years. In cases involving the death of a child under the age of 13, a person may be sentenced to life imprisonment.
Child sexual abuse in the second degree may include cases involving injuries to children that do not rise to the level of first-degree child abuse. A person who is convicted of second-degree child abuse may be subject to a maximum prison sentence of 15 years.
Child Neglect Charges
In Maryland, child neglect is governed by Maryland Code, Criminal Law Section 3-602.1. Child neglect is defined as intentionally failing to provide a child with resources and assistance to ensure that their physical and mental needs are met, leading to a substantial risk of harm to the child's physical or mental health. A parent, family member, or household member who commits child neglect may face misdemeanor charges. If convicted, a person could be sentenced to up to five years in prison and/or a fine of $5,000.

Child Sexual Abuse
The offense of sexual abuse of a minor is governed by Maryland Code, Criminal Law Section 3-602. A family or household member or a person who has the temporary custody or care of a child may be charged with this offense if they are accused of committing rape, sexual assault, incest, and other criminal sexual conduct against the child. This crime is a felony punishable by up to 25 years in prison. A person convicted of this offense will be required to register as a Tier III sex offender for the rest of their life.
Child abuse by a custodian does not only apply to parents. A custodian is anyone who has permanent or temporary custody of a child. In other words, this includes babysitters, daycare providers, teachers, and coaches, as well as other family members or friends; anyone who is left with care and custody of a child, even for a short period of time, can be deemed a custodian.
