Maryland homicide laws are broken down into three types: murder in the first degree, murder in the second degree, and manslaughter.
A murder is considered murder in the first degree if it is:
- A deliberate, premeditated, and willful killing;
- Committed by lying in wait;
- Committed by poison; or
- Committed in the commission of or in an attempt to commit one of the following felonies:
- First degree arson;
- First, second, or third degree burglary;
- Carjacking or armed carjacking;
- First degree escape from a correctional facility;
- Mayhem;
- Kidnapping under Md. Code Ann., Crim L. Section, § 3-502 or § 3-503(a)(2);
- Rape;
- Robbery under Md. Code Ann., Crim L. Section,§ 3-402 or § 3-403;
- First or second degree sexual offense;
- Sodomy; or
- A violation of Md. Code Ann., Crim L. Section, § 4-503 concerning destructive devices.

First degree murder is a felony that carries a penalty of life in prison or life in prison without the possibility of parole. Md. Code Ann., Crim L. Section, § 2-201(b)(1).
A murder is considered murder in the second degree if it is a murder that was not covered by the aforementioned list in Md. Code Ann., Crim L., § 2-201(a).
Manslaughter is a common law felony is defined as “the unlawful and felonious killing of another, without malice aforethought, either express or implied” Rolfes v. State, 10 Md. App. 204, 268 A.2d 795 (1970). Voluntary manslaughter requires premeditation. Upon conviction of manslaughter, a person is subject to a term of imprisonment not exceeding 10 years or imprisonment in a local facility not exceeding 2 years or a fine not exceeding $500 or both. Md. Code Ann., Crim L., § 2-207. An example of voluntary manslaughter is if a physical fight leads to the death of another individual.Involuntary manslaughter is the result of a reckless, negligent, or criminal (non-felony) action that leads to the death of another. It requires neither malice nor premeditation.

What should I do if I get arrested?
When you get arrested, the very first thing you should do is call an experienced, aggressive, highly skilled defense attorney. You don't want to call just any lawyer because some lawyers don't do criminal work. Some lawyers do criminal work, some of the time.

What should I say during an interrogation?
During an interrogation, your best play is always to say nothing. It doesn't matter what the police promise you, it doesn't matter what anyone promises you, keep your mouth closed and call your lawyer immediately. We're here to help.
Am I going to jail?
Whether or not someone goes to jail is going to depend upon a number of factors. What are the charges against you? What's your criminal history like? Is it a high profile case that's going to put pressure on the prosecutor to go against you in a very aggressive fashion? And most importantly, what is your criminal defense attorney like?

Will my boss find out I've been arrested?
Whether or not an employer finds out about your arrest is oftentimes up to you. However if you have a job that requires a security clearance or you're working with children or you're driving a vehicle, you will oftentimes have to tell your employer. It varies on a case by case basis.
