If the police pull me over, can they search me if they just smell marijuana, which has been decriminalized for less than 10 grams?
No. The state’s highest court recently held that while the smell of burnt marijuana may give an officer probable cause to search a vehicle, the officer cannot search your person unless they have probable cause to suspect that you have at least 10 grams of marijuana or are driving under the influence.
What makes something distribution or possession with intent to distribute versus simple possession?
Distribution can be something as simple as passing a joint to another person at a party; money need not be exchanged. Possession with intent to distribute depends on quantity and other surrounding circumstances.
Are ecstasy, MDMA, etc. serious drugs to possess?
Yes. While a recent change in the law changed the maximum penalty for a first offense of possession of any drug (other than marijuana) from 4 years to 1 year incarceration, the crime is still very serious, as are the penalties.
